SOFTWARE USE LICENSE AGREEMENT FOR ALL TERRITORIES
YOU SHOULD COMMIT TO OBSERVE THE FOLLOWING TERMS OF THIS LICENSE BY PROTECTING, INSTALLING, OR USING THE SOFTWARE. IF YOU DO NOT AGREE, YOU HAVE NO RIGHT TO SAVE, INSTALL OR USE THE SOFTWARE REFERRED TO IN THIS LICENSE.
The App Consultations Ginefiv, hereinafter "Ginefiv software", contains software developed for Ginefiv by GEA Gades, S.L, from now on GEA Gades. The Ginefiv software is part of the intellectual property of GEA Gades. GEA Gades grants permission to use Ginefiv. GEA Gades being the sole owner of all copyright, trademarks and intellectual property rights of the software or derived from it. The use of the software by third parties is governed by the respective license terms and conditions specified in the license menu.
1.- Ginefiv Software License Terms
The App includes content provided and developed for Ginefiv, for the sole purpose of improving the communication of its patients and the clinic. Therefore, the User understands and agrees on:
- The collection, archiving and use of data by the application within the device being installed (including, but not limited to: (a) information on end-user devices, make, model, operating system name and version and the Version of the kernel, (b) information about the Ginefiv software used to create the software application, such as the version and profile of the device, and (c) information about the software application and its use as configuration (Eg configuration settings), start and stop dates and data included in these and other general-purpose information)
- Internal access to the application web page at http://ginefiv.geagades.com/en/ for additional information on the recommendations the application offers, as well as direct access to contact directly via an online form and telephone, making use of Of direct links and not of applications that mark automatically.
- Each of the end users is aware of the dangers of using an application on a mobile phone while driving, walking, or in any case being distracted or disoriented in situations during daily life.
2.- License
Ginefiv grants the User a personal, non-exclusive, non-transferable and non-sublicensable right to use the software in object code form for installation and use in a single device with a suitable operating system.
3.- Restrictions
The end user is not authorized to: (a) copy, reproduce, distribute or otherwise reproduce the software or parts thereof, except for data recovery purposes, or (b) sell, lend, lease, license , Sublicense, distribute, assign, transfer or otherwise transfer the software or part thereof to a third party, (c) modify or transfer the software or use it for its own development purposes, (d) combine or merge the software with other software , To decompile the software in any way, to disassemble, reverse engineer the software or otherwise with the intention of trying to deduce, identify or know the source code, algorithms or intellectual property contained therein, (e) To make use of the technical solutions contained in the software for other purposes.
4.- Cost of the License
The software usage fee will be granted free of charge.
5.- DISCLAIMER OF WARRANTY
DUE TO THE NATURE OF THE SOFTWARE as a freeware, THERE WILL BE NO WARRANTY FOR THE PROGRAM, TO THE EXTENT PERMITTED BY APPLICABLE LAW. THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. THE RISK AS TO THE QUALITY AND PERFORMANCE OF THE SOFTWARE WITH THE LICENSEE. IF THE SOFTWARE RESULTS TO BE DEFECTIVE, THE USER HAS TO ASSUME THE COST OF ANY SERVICE, REPAIR OR CORRECTION.
6.- LIMITATION OF LIABILITY
IN NO EVENT SHALL GINEFIV BE LIABLE TO YOU FOR DAMAGES, INCLUDING ANY GENERAL, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE THE SOFTWARE (INCLUDING, BUT NOT LIMITED TO, LOSS OF INFORMATION, CONSIDERATIONS, LOSSES SUFFERED BY YOU OR THIRD PARTIES OR A FAILURE OF THE SOFTWARE TO OPERATE WITH ANY OTHER SOFTWARE), EVEN IF SUCH HOLDER OR ANY OTHER PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
7.- Duration and Termination
The right to use the license begins with the acceptance of the terms of this license. GEA Gades or Ginefiv has the right to terminate this agreement and the user's right to use it at any time and unilaterally and without prior notice, informing the Holder that the software services can not be offered any longer. The license agreement terminates with immediate effect if the User has breached any of its obligations under this agreement. Once the agreement has been finalized, the User must terminate the use of the software immediately and in the same manner proceed to uninstall and delete all copies of the software.
